career.co.nz does not monitor this Site at all times, but reserves the right to do so. We take no responsibility for any material input by others and not posted by career.co.nz. User acknowledges and agrees that user is solely responsible for the form, content and accuracy of any material contained therein placed by the user are solely responsible for their postings in the JOBS Database. We are not responsible for the content of any other WebSites linked to the Site; links are provided as Internet navigation tools only. career.co.nz does not warrant or guarantee that a job description shall be viewed by any specific number of users, or that it will be viewed by any specific user.

4. Overriding Condition

Neither career.co.nz nor any of its officers, employees or agents is liable for any loss or damage howsoever caused in respect of advertisements altered, delayed or omitted, whether by negligence, mistake or otherwise. Any other liability of career.co.nz or any of its officers, employees or agents howsoever arising in respect of any advertisement or series of advertisements is limited to a total of $5.00 for each advertisement or series.

career.co.nz makes the stipulations contained in the last proceeding two sentences on behalf of each of its officers, employees and agents and in addition, the ADVERTISER agrees with career.co.nz not to bring or be party to or assert any action, claim, counterclaim of set-off against any of them at variance from the protection sought to be extended to them in this condition.

5. Indemnity.

Advertisements are accepted for publication on the condition that the ADVERTISER and the accredited advertising agent jointly and severally warrant to career.co.nz that no material, statement, information or matter contained in the advertisement constitutes a violation of any existing copyright or trade mark or a breach of confidence or contains anything obscene, indecent, libelous or in contempt of any court, tribunal or Royal Commission and that its contents do not and its publication will not in any way infringe the Commonwealth Trade Practices Act 1974 or any other statute, regulation or law whatsoever and that the ADVERTISER and the accredited advertising agent jointly and each of them severally agree to indemnify and keep indemnified career.co.nz and its officers, employees and agents against all claims, demands, damages, costs, penalties, suits and liabilities of any nature howsoever caused whether by negligence or otherwise incurred by career.co.nz or its officers, employees or agents. The acceptance and publication of the advertisement by career.co.nz shall be deemed to be the consideration for the granting of the aforesaid warranty and indemnity. The aforesaid warranty and indemnity shall be implied in each submission of an advertisement for publication without the necessity for the execution of any other document.

6. Acceptable Site Use.

(a) Specific Prohibited Uses. The career.co.nz Site may be used only for lawful purposes by individuals seeking employment and employers seeking employees. career.co.nz specifically prohibits any use of this Site, and requires all users to agree not to use this Site, for any of the following:

(i) Do Not respond to any employment opportunity on the JOBS Database for any reason except to apply for the job. Communications soliciting the employer's business by our competitors are prohibited.

(ii) Do Not delete or revise any material posted by any other person or entity.

(iii) Do Not print out or otherwise copy or use any personally identifiable information about employees or business information about employers. Unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and companies are prohibited.

(b) Web Site Security Rules. Users are prohibited from violating or attempting to violate the security of career.co.nz, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which such user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,(c) attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mailbombing" or "crashing", or (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. career.co.nz will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

(c) General Rules. Users may not use this Site in order to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or (c) that is libelous obscene, threatening, abusive or hateful.

7. Suspension, Termination.

Any user which career.co.nz determines to have violated any element of these Acceptable Site Use Rules may receive a written warning, and will be subject at our discretion to a temporary suspension of service pending such user's agreement in writing to refrain from any further violations; provided, however, that if we deem it necessary, we may immediately suspend or terminate such user's service without issuing such a warning. Users which we determine to have committed a second violation of any element of these Acceptable Site Use Rules shall be subject to immediate suspension or termination of services without further notice.

8. Privacy.

Personally identifiable information posted to Email Jobs is confidential and may not be viewed by anyone with access to the Site other than yourself. We may use the information to contact you about our employment services. If you want career.co.nz to remove your JobsDirect profile or to cease any other use of personally identifiable information, you should send us a specific request by certified mail or by regular mail clearly marked "Privacy-Urgent", in either case, addressed as follows: Level 1, 7 Kelly Street, Ultimo NSW 2007. You may send you request by e-mail to help@career.co.nz but due to the volume of e-mail we receive, it may not secure prompt attention.

In addition to the terms and conditions that may be set forth in any privacy policy on this Web Site, users understand and agree that the career.co.nz will not disclose to any third party your name, address, email or telephone number without your prior consent, except as required by law.
